New rules have come into force at the Canadian Intellectual Property Office for the accelerated prosecution of patents and applications relating to green technologies.
Under the new procedure, examination of a Canadian patent application shall be accelerated ahead of the normal queue, on filing of a declaration by the applicant “indicating that the application relates to technology, the commercialisation which would help to resolve or mitigate environmental impacts or to conserve the natural environment and resources”.
There is no government fee for requesting accelerated examination. Canadian patent applications which are not yet published, cannot be accelerated until they are published.
